WeSmile AI Photobooth and Videobooth utilizes technologies such as ComfyUI, Stable Diffusion, and Vertex AI for the generation of images and content via artificial intelligence ("AI"). Due to the nature of AI technology, WeSmile cannot guarantee or predict the exact outcomes of the generated content. Consequently, WeSmile cannot be held liable for any disputes, claims, liabilities, damages, losses, costs, or expenses arising from or in connection with the AI-generated content provided through the Services. The Client acknowledges the unpredictable nature of AI-generated content and accepts the risks associated with the use of such technology within the Services.Provider: WeSmile ("Provider")Client: Event Organizer ("Client")1. Services: The Provider agrees to grant the Client access to an AI photobooth entertainment setup, including the use of generative AI models, for the duration of the event specified by the Client.¹2. Theme and Parody: The image generation of the photobooth setup, supported by Generative Artificial Intelligence (Stable Diffusion SDXL1.0), is intended ²as a parody or interpretation of various themes, including but not limited to the Client's list. The Client acknowledges that the photobooth setup is intended solely for entertainment purposes and that the Provider has no intention to infringe upon any intellectual property rights of the themes or elements used.3. Intellectual Property: The Client acknowledges that all AI-generated images or other intellectual property used in the photobooth setup are intended to be in accordance with the principles of fair use for the purposes of parody. The images represent the generative AI's interpretation of general themes, inspired by and created for entertainment and private use. The Client agrees not to reproduce, distribute, or use for commercial purposes any images or content generated by the photobooth setup without the express permission of the respective copyright holders.4. Nature of AI and Image Use: The Client acknowledges that the AI images generated by the photobooth setup are inspired by the chosen theme and are intended solely for entertainment and parody purposes. The Provider uses the term 'inspired by' within the AI photobooth system to clarify that the generated content is a creative interpretation and is not intended to infringe upon any intellectual property rights. The nature of AI technology means that results may vary and that no guarantee can be given that they will accurately represent individuals or prevent unintended outcomes. The Client agrees that the generated images are for the private use of event attendees and may not be used for other purposes without their express consent.5. Indemnification: The Client agrees to indemnify and hold harmless the Provider, its affiliates, employees, and agents from any claims, damages, or liabilities arising from or related to the use of the generative AI model integrated into the AI photobooth entertainment setup by the Client or their event attendees. This agreement shall remain in effect each time the client signs up for WeSmile's AI photobooth service.
