AI Content Disclaimer

AI-Generated Content: WeSmile AI Photobooth utilize technology including, but not limited to, ComfyUI and Stable Diffusion, Vertex AI for the generation of images and content through artificial intelligence ("AI"). Due to the inherent nature of AI technology, WeSmile cannot guarantee or predict the exact outcomes of the content generated by the AI. Consequently, WeSmile shall not be held liable for any disputes, claims, liabilities, damages, losses, costs, expenses, or fees arising out of or in relation to the content generated by the AI through the use of the Services. The Customer acknowledges the unpredictable nature of AI-generated content and agrees to bear the risk associated with the use of such technology within the Services.

WeSmile AI Photobooth Entertainment Agreement
WeSmile ("Provider")
Clients ("Client")

1.Provider agrees to provide Client with access to an AI photobooth entertainment setup, including the use of generative AI models, for the duration of the event specified by the Client.

2. Theme and Parody: The image generation of the photobooth setup, supported by Generative Artificial Intelligence Stable Diffusion SDXL1.0, is intended to be a parody or interpretation of various themes, including but not limited to the client’s list. Client acknowledges that the photobooth setup is intended solely for entertainment purposes and that Provider has no intention of infringing on any intellectual property rights associated with the themes or elements used.

3. Intellectual Property: Client acknowledges that any AI generated images, or other intellectual property used in the photobooth setup are used in accordance with fair use principles and for the purpose of parody, and the Generative AI’s interpretation on general themes, inspired by and for entertainment and private usage. Client agrees not to reproduce, distribute, or use any images or content generated by the photobooth setup for commercial purposes without the express consent of the respective copyright holders.

4. Nature of AI and Image Use: Client acknowledges that the AI-generated images produced by the photobooth setup are inspired by the chosen theme and are intended for entertainment, parody purposes only. Provider utilizes the term 'inspired by' in the AI photobooth system to clarify that the generated content is a creative interpretation and not intended to infringe upon any intellectual property rights. The nature of AI technology means that the results may vary and cannot be guaranteed to accurately represent individuals or avoid unintended outcomes. Client agrees that the images generated are for the private use of event attendees and may not be used for any other purpose without their explicit consent.

5. Indemnification: Client agrees to indemnify and hold harmless Provider, its affiliates, employees, and agents from any claims, damages, or liabilities arising out of or related to the Generative AI model integrated into the AI photobooth entertainment setup by Client or their event attendees.

This agreement shall remain in effect whenever client signs up for WeSmile's AI photobooth service.
